A few months ago, I started going through the process of landing my dream job working at a not-for-profit as an instructor for developmentally disabled adults. The hiring process was slightly grueling, but getting started was even more so: I had to get drug tested, TB tested, state and federal fingerprints and background checks, a full physical, my commercial driver's license, and I had to go through a crap-ton of training- practical and theoretical. I got CPR and first aid certified, took a self-defense class, and on my own, I began learning ASL because one of my girls is completely deaf and no one ever even taught her to finger-spell, let alone read.

I finally got started with the actual job, which I didn't even like leaving in the evening. Every day I thought to myself, "I wish I had a few more hours with my girls". We were all having a blast... until Friday came along and I got called into my supervisor's office. "Something has come up in your federal background check, Becca, we don't know what it is, but we got a call from the licensing board, and you have to leave the premises immediately after you pick up your paycheck and sign some papers." I was devastated; not just for losing my dream job, but because my girls had been waiting for me for two months, and I was leaving them. Plus: what the hell could have POSSIBLY shown up on my background check?

Turns out, it was from an arrest from eleven years ago, in which I was charged with assault and harassment of a police officer. The charges were thrown out of court because I hadn't done anything wrong, and the cop was subsequently fired. My record, which should have been sealed, never was, and I was terminated because of my "violent tendencies". Fuck that. I've never, and would never, put my hands on anyone inappropriately, but there's not really much I can do to change all of this around.

Sorry for the long story; I just thought this was a good place to put it. This thread makes me really sad Sad

OMG Becca, I'm truly sorry. Can you produce some sort of proof, such as the decision from the court, that you weren't in the wrong? Also, write a pleading to the court to have that removed from your records since you were found not guilty and the cop was fired.

If your employer can get those things, would they be willing to re-hire you since it was an obvious mistake on the courts behalf to not seal these records? At the very least, that should be expunged, but given as you were found not guilty, there shouldn't be anything to expunge.

Also, if this happened when you were a juvenille, then you may have recourse against the court for not sealing those records anyway.

Eventually, I can, but it will take a lot of time and money that I don't have. Add to that, the judge and my lawyer are both dead now, so it's even tougher.

The records weren't sealed when they were supposed to be, and the verdict was filed wrongly, so it's going to be hard to prove. They will consider hiring me back, but I have an entire appeal process I'm going through, including letters of reference from three people who aren't my family. Luckily, I have at least ten friends/old co-workers/professors, etc. helping me out with that. Regardless, I probably won't be able to get hired back because they'll need to hire someone to replace me in the time it takes to get all of it done. The biggest silver lining I'm considering is clearing my name with the amazing people I was working with, and if I get my job back, I'll consider myself lucky.

Unfortunately, the incident happened in the state of NY, and there is no expunging available; the best I can hope for is to get the record sealed.
