A judge could easily rule that a bakers pursuit of happiness is sufficient cause for him to refuse to serve gay weddings.
If the baker own his own shop then he is perfectly within his rights to refuse a gay couple service, infact he can deny anyway for pretty any reason he wants. Mind you i think it damn stupid, I would disagree with peole refusing service to gay weddings, but people have their beliefs however backwards and I can force my beliefs on others
The baker would be issued a license to sell his cakes. He would be required to follow state laws or risk losing his license. In many states, the baker would be within his rights to refuse to bake a gay couple a cake, but he would not be within his rights to refuse to bake the cake because the couple is gay.
Whether this is fair is irrelevant considering the topic of our conversation is same sex marriage and not wedding cakes or baker's rights.
