RE: Why not sue or boot them off to jail?

First, the case of thieves suing victims for injuries is completely idiotic IMO.
Second, it is not taken seriously because you are free to have sex with whoever you want to, and over here if someone cheats you can use that as an argument for divorce - If it's serious enough, you can sue someone for emotional distress (deliberately harmful) - But this can be done with cheating or any other action that causes the same. As for gambling addiction, that's entirely different - You're taking advantage of someone who has problems. In the case of cheating, it is just a choice - To have or not have sex with another person (or kiss, whatever) - It goes against the contract of marriage and it should be dealt that way, cheating allows the other part to call off the contract, plain and simple.
I don't think it should be treated as a criminal or civil offence.
By the way - Don't fucking confuse civil with CRIMINAL charges - Civil charges, such as the ones thieves usually press for physical damage are less serious and don't get you jailtime, usually you pay a compensation for the damage done - The common example is Mr X crashes against Mr Y's car and only damages the vehicle - He pays for the repair and loss of profit caused to Mr Y - This is a civil offence, not a criminal one. Criminal offences are the most serious and damaging conducts an individual can have while living in society - Do you really think criminalizing cheating is worth it? Do you really think (and criminal offence assumes most times that you can go to jail) that someone who cheats should go to jail? You got your values mixed there buddy - No criminalization unless it's something serious, conducts should only be crimes if they attempt against what's more important in a society, EG Life, physical integrity, patrimony - You may prefer to be stolen, but that's just your opinion, if someone stole a 300000€ worth painting, some people would rather be cheated by far - And your opinion, like any other individual opinion, should not dictate criminal law (just because you are offended by cheating - I think rudeness is annoying and sometimes I wish it was a crime, but it would be unfair and non impartial). BTW, I am sorry if the 'legal' words I use are not correct, I cannot talk much about law in english since my native language is portuguese, I should probably take a course to learn english words regarding legal matters, it would help me a lot.
