I think private prisons might make work...it's technically a legal version of slave labor, but that already exists in the current system as well.
That doesn't change the fact that they're run for a profit, and humans being humans, of course lobbies are going to sprout, especially in a corporate paradise like the USA. Which means laws like this, and the forced labour of people who would much more likely need medical assistance like drug addicts.
Punishment should work as a way to reeducate criminals, not as a way to keep fat men feeding.
