On appeal, the Texas Court of Criminal Appeals unanimously reversed his conviction and sentence. The court remanded the case to the state trial court with instructions to hold a new trial. I thought that I made that clear enough, the court only reversed the conviction because in the same jurors must used to decide the sentencing. The issue with the one juror only concerned sentencing, absolutely nothing was in question about the conviction itself.
