In reality the person who is transitioning probably wants neutral facilities anyway. They'll be self conscious about passing and won't want to go into their assigned toilets / bathroom. Many places have disabled toilets and these are ideal.
But for many people it takes a long time to save up money for SRS (sexual reassignment surgery) or there may be a long waiting list in countries where it is free. And even though they pass quite successfully, and normally they will be able to use the toilets without any bother from anyone else. The NC laws means that these people have to continue using completely inappropriate facilities which would be uncomfortable for everyone involved.
