That's why you should have mandatory sentencing for shit like this. The same people who want a rehabilitative prison system are those that cry foul when that same soft on crime system lets someone off easy who did something horrible to one of their own. I would give that guy the death penalty or life in prison. That the victim is gay is irrelevant, his motive is irrelevant, it's all irrelevant other than that he killed someone. Justice needs to be blind and as long as we classify stuff with motive and the like this is what happens.

In other news, the worst serial killer in modern history was released by Ecuador because they have a maximum sentence of 20 years and nobody in the west seemed to notice. He raped and killed 300 young girls. It equals about 1 month of time for every person he killed. His whereabouts are unknown.

You don't need mandatory sentencing unless you have compiled all the possible events into a coherent set of laws.

The massive problem is what lead the idiot judge up to "3 years".

Aggravating circumstances were seemingly ignored.

Well we have a system that is subject to human error. You can't expect a perfect system when people are in charge. This stuff will always happen when judges decide sentencing. If certain crimes always carried certain sentences then this wouldn't happen. You can't have it both ways and then complain when it fails.

Sheard then held a cigarette lighter to Steven's groin, and the oil ignited, setting the teenager on fire. Sheard then ran away from the scene, and a neighbour, Sean Banner, was said to be the only person who helped the tragic teen as he was engulfed in flames.

Judge Roger Keen told Sheard that his running away from the scene had caused him 'serious aggravation' in setting his prison sentence.

The Mirror reports that he told Sheard that the evening had involved good-natured horseplay' but that putting a flame to a man doused in flammable fluid was 'a highly dangerous act'.

Sheard had initially claimed that Steven had set himself on fire, but eventually admitted the charge of manslaughter and was jailed for three years and six months.

His lawyer Andrew Smith said the incident was a 'criminally stupid prank that went wrong in a bad way' and added that his client had been 'deeply and significantly affected by what he has done and the tragic consequences that ensued from it'.

Okay. Totally the Judges' fault here. Anyone care to guess why? Next I'm going to go see his voting history on matters pertaining to sexuality.

I can't recall any actual perpetraters in the US being charged with such a crime.. I do however recall stories like this one, of unknown victims being found burnt to death on the side of the highway or in the desert. Maybe it's an American MO.
I found plenty of videos from other nations though of people burning to death. Apparently they just don't video tape them here/do their atrocities in a public setting.

If I were to create self aware beings knowing fully what they would do in their lifetimes, I sure wouldn't create a HELL for the majority of them to live in infinitely! That's not Love, that's sadistic. Therefore a truly loving god does not exist!

Could you enlighten me as to what you find idiotic about the law being applied evenly to people? Also judges most certainly are not capable in the vast majority of cases. Are you aware of the differences in death penalty cases between people with public defenders and those without? With mandatory sentences for crimes like murder it makes an egalitarian system that is incapable of making an error like this.

I mean you want to make this about the guy being gay and be outraged but propose no solutions other than have better judges. I would posit that it is impossible to have better judges because people are human beings and subject to bias, error, corruption.

When you admit that not all cases of murder are the same.

There is verifiable stupidity, there is luring under the guise of stupidity, etc, etc,.

Applying the same punishment, say to a young adult who was coerced to murder under threat and someone who desired to kill the victim and planned it willfully, is fundamentally unjust.

I would posit that assholes like you are the reason that we don't implement feedback systems, anti-corruption and anti-bias panels, not set up metastudies that are not paid for by either entities interested in imprisoning (jails, sheriffs assocs) or interested in freeing all prisoners (Amnesty Intnl, etc)...

As for the OP: See, this is why, whenever someone tells me that European courts are better than American courts, I say "Uh. In what way, exactly?" This is a fucking atrocity against justice. Three years for manslaughter?! FUCK THAT! That's fucking murder in the third degree. What prosecutor accepted that shit??
