American Atheists suing over Ground Zero Cross

The story in short: a cross-like structure was found at Ground Zero, and became a symbol for some. A museum (run by a NGO) wants to exhibit it. American Atheists filed a lawsuit, arguing that this symbol gives a feeling of exclusion to non-christians and that it is a constitutional violation.

In my view, since the government isn't even involved, i do think American Atheists have been kind of wrong with that lawsuit...but i'm not sure.

Regardless of whether atheists disagree about what to do with this cross, I think can all agree that we need to choose our battles carefully. I personally don't have any problems with the cross, but even if I did, I wouldn't think it was worth the negative PR. Hell, even last night's Daily Show ripped on this lawsuit and went as far as to call the head of the AA a dick.

In the U.S. we self-proclaimed atheists have to deal with the negative stigma we don't deserve, and this lawsuit will only enflame people's dislike and distrust towards us as a group. This was an unwise action and looks very childish. When you add on the emotional factor of this being a 9/11 memorial, we come off looking like complete assholes whether that's a deserved title or not.
Even if the open windows of science at first make us shiver after the cozy indoor warmth of traditional humanizing myths, in the end the fresh air brings vigor, and the great spaces have a splendor of their own - Bertrand Russell

One would also point out that the Establishment Clause of the I Amendment prohibits government from establishing or playing favourites with religious belief. It does not prohibit private organisations, such as a museum, from doing so.

On the other hand, the other clause in there, freedom of religion and freedom of speech, would apply to a private organisation.

Such a lawsuit (from a non-legal scholar, myself) would likely be tossed as being without merit.
