What law are you citing? It sounds like you're quoting the Communications Decency Act of 1996. That's been struck down.

I have no idea what the law is or who the host is. I only know that Tibbers says he liable for pornography when there are minors and I take him at his word for that. That's not the only reason either. We need the ads to cover the cost of running the forum. That won't happen if no one wants to place ads with us. That's really the extent of my knowledge. You'd have to ask someone else if you want to know anything more specific than that.
