No, he intentionally fired at the helicopter in the mistaken belief that his gun contained blanks.
But:
a helicopter which is "not operating" is sitting on the ground which means this was not part of any military exercise. In other words, this yahoo just wanted to squeeze off a few rounds just for the fuck of it.
