If someone tries to deny a crime being a hate crime, I can see how some could take it as an indirect defense of the act/perpetrator, since it makes the crime less terrible.
So, it would be less terrible if that was a black able person? I have to disagree. Racism is reprehensible, but motive really doesn't change the outcome. Sure, self-defense and crimes of passion can be viewed differently. However, any unprovoked violent crime with the same outcome is equally terrible without inclusion of motive.
