Yes there are laws against trademark infringement....but there are also laws against desecrating other peoples property. The point of the Micky example was to show that Free Speech doesn't always give you a free pass. If private property can be protected against trademark infringement why can't private property be protected against desecration?

The kid should get his own Jesus statue if he wants to simulate sex acts with a Jesus statue instead of desecrating someone else's.

As far as I know, there are NO laws against "desecrating" anyone's private property other than, in some states, so-called "venerated objects".

The idea is, one can "hurt" private property without actually changing it physically in any way. It's all about the sensibilities of the religious.

That, right there, is the problem. Do you not see it?

Because unless you are specifically referring to cemeteries or US flags, most states don't have desecration laws?

Pennsylvania probably won't have one much longer if the kid decides not to plead out & the ACLU takes his case. The law's language is far too broad as it stands.

I'm pretty sure most states have laws against desecrating corpses.....so I think your claim about desecration laws is wrong. If the kid took a picture of himself simulating a sex act with a corpse I doubt you atheist types would be in an uproar like you are now. Its only because it is the desecration of a religious symbol that you want to give it a pass.

If the kid did take a picture of himself simulating a sex act with Christopher Hitchen's corpse, do you think the ACLU would fight for him if he was being prosecuted?
