I don't see how it could be hardware, it is brand new. I also set the mouse pad back to factory settings, it took me a couple of attempts but it seems to have stopped and it has a two year manufactures warranty.
Well, the thing is, did you change the mouse settings? I have to assume not. So either it's hardware, or a Windows update decided you needed to "improve" your mouse performance. If the mouse started working RIGHT after you tried factory settings, you're fine. If you had to restart your computer, try factory settings a few times, restart again, try again, then the "fix" might have been coincidental.
But on a new system, sometimes new software installations or especially Windows updates can bugger something. TBH I don't think mousepads really fail that often, so my guess is you'll be fine.
