Ms Miller said that if the Supreme Court rejects the Government appeal against the High Court ruling, Mrs May should not try to bypass the Lords.
She told The Daily Telegraph: "[There needs to be] proper debate in both houses and an act of Parliament. A resolution or a motion wouldn't be debated in both houses."
The move, should it happen, may prove to be an issue for Prime Minister Theresa May as the Conservatives do not have a majority in the Lords.
MPs were warned they would be attempting to 'thwart' the will of the people if they refused to endorse the plans.
The run-up to the debate on a Labour opposition motion was dominated by a major U-turn from Mrs May.
