Courts and ACLU are all over their ass for prison problems. Also, they've had a riot with IIRC a couple fatalities. Dire personnel issues too, required overtime isn't standing up in court, and prison system just can't attract sufficient employees to work there.
Nebraska either figures out a solution, or the courst are going to be running their prison system for them, and the courts aren't going to care about blowing the state finances to smithereens to do it.
Comes down to $$$. If fixing problem themselves is realized to be cheapest answer, Nebraska unicameral will be all over it like pale green on baby puke.
