It's not a no true Scotsman fallacy, because if someone is talking to God, then they obviously believe that this god exists and therefore cannot be an atheist. It's not a no true Scotsman fallacy if the characteristic being described is against the definition of what you're talking about. If I say "There are no birds without feathers. The bat doesn't have feathers, therefore it is not a bird" it is not a no true Scotsman fallacy, it's based on scientific fact.
