1. Batmans intelect makes Peter Parker look like a bumbling idiot next to him. He would figure out his identity, how he got his powers and his weaknesses all before PP made his first wise crack of the day. Hell a giant bathtub would be enough to stop him.
2. Batman can and has taken down beings so powerfull that a fight with spidy would be the equivelent of mike tyson fighting a toddler.
For example he has taken down the entire justice league. Including superman. An alien so powerful that he could leave spidey as nothing more than a bloody smear just with the flick of a finger.
As for identities, pretty much any woman Bruce has ever met knows his identity. Also even if he knew Peters identity, spidey doesn't need his suit to be powerful, unlike someone in black tights.
2) Yes it would be a tyson vs toddler with batman being the toddler, spidey can benchpress a TON, and that too without his newer suits. As for fighting superman, Sups just took pity on bat cause Bat broke his kryptonite ring by just punching Superman, oh and don't forget, batman needed extra help from the green dude just to face him. He struggles so much even against villains like the penguin, how many times did spidey had to take his battles seriously?
Theoretically, there is a probability that Batman can beat Spiderman, but he is simply outclassed by spiderman in almost everything, except in finance.
