as in, say, out of print books?  If the IP doesn't have an owner they're free game.  Tons of classics (and, increasingly, more recent works) are in that state.  Copyrights don't last forever, you know.  

Or, more like abandonware?

Both. I recently downloaded a book from a torrent site that is out of print and not available at any online vendor. But it also isn't in the Public Domain either. The only way to get it is to download what copies exist on torrent sites.
