A three-judge appellate panel on Thursday reversed a summary judgment issued two years ago by U.S. District Judge Margaret Morrow, finding some of the officers’ claims to be “implausible.”

“Most obvious is the fact that Cruz didn’t have a gun on him, so why would he have reached for his waistband?” wrote Chief Judge Alex Kozinski in a unanimous decision.

“Nobody likes a game of ‘he said, she said,’ wrote Kozinski, a Ronald Reagan appointee. “But far worse is the game of ‘we said, he’s dead.’ Sadly, this is too often what we face in police shooting cases like this one.”

Masked California cop accused of beating woman with a baseball bat

A 30-year veteran of the Walnut Creek, California police force is accused of attacking a woman with a baseball bat while wearing a mask to conceal his identity.

According to KTVU, Richmond, California police arrested 53-year-old Gregory Thompson at around 2:00 A.M. on Aug. 16 after residents called police to report a woman screaming.

This thread. I come here because I have no cable and I feel like it's a smart idea to keep up on this, but I always end up regretting it.

I also learned the other day that the police departments don't have to report to anyone specific when their officers use deadly force. So we don't know how many people are killed by police every year, but it is estimated that Americans are 8 times more likely to be killed by a police officer than a terrorist.

I'm not sure the credibility of the article but I will see if I can find the link.

Yet Hartfield was neither freed from prison nor given a new trial. Last April, a Texas trial judge held that he must remain in prison, despite the fact that the sole legal basis for his detention was overturned nearly 34 years ago, because Hartfield did not actively seek a new trial.

Hartfield is intellectually disabled. His IQ is estimated to be only 51.

This is another one of those "don't tell the whole story because it will kill the newsworthiness" blurbs.

It wasn't his conviction that was overturned but his sentencing, but to be properly sentenced they would have to redo the entire trial. So instead of going through another death penalty trial, the governor went ahead and commuted the sentence to life. Now people want to make hay that this wasn't following proper procedures. His guilt was not in question.
