They'd literally have to throw out years of gender equality jurisprudence to come to that ruling. Not saying couldn't happen since Scalin is a truly evil waste of oxygen who has disagreed with his own previous rulings when it suited him. Of course doing that on such an incredibly hot button issue could very well lead to his impeachment, depending on the make up of Congress the time & how much we the people wanted his ass gone.

There are anchors trying to hold back progress.

From the graph earlier, they don't seem to be making remarkably good progress.

A strong enough ship can heave up ANY anchor.

19 states in 10 years, with 17 of them in the last 5 years and another 12 with overturned bans, waiting on appeals process to be finished? I think that 29 overturned bans in 5 years is amazing progress actually. Once there's that majority of 31 officially, the other half won't have very strong standing on their religious opinions and it will be completely against constitutional rights. Every state will eventually have to follow suit.
"Yes, I am a Free Lover. I have an inalienable, constitutional and natural right to love whom I may, to love as long or as short a period as I can; to change that love every day if I please, and with that right neither you nor any law you can frame have any right to interfere. And I have the further right to demand a free and unrestricted exercise of that right, and it is your duty not only to accord it, but as a community, to see I am protected in it. I trust that I am fully understood, for I mean just that, and nothing else."
— Victoria Woodhull, “And the truth shall make you free,” a speech on the principles of social freedom, 1871

Except you can't impeach them for less than a felony. Unless you can show criminal misconduct they are in there till they die or retire. And as such they might rule that states have the right to determine marriage since it is an issue explicitly left to the states, and therefore the laws are valid. And making this decision would not be considered criminal misconduct.

Yet this is the court that threw out DOMA and sent the jesus freaks scurrying for the bomb shelters.

They also said hobby lobby has the right to deny contraceptives based on religious preference.

One has nothing to do with the other and the DOMA decision was based on a 1996 SC precedent case, Romer v Evans.

Thinking
Gotta chime in on this one. Once upon a time I was the Chief Pilot for a large Catholic University, operating their corporate turboprop. I was glad they didn't take that whole "vow of poverty" too seriously since I needed the job. (By the way, I don't think they cared that an atheist was driving their plane. So far as I could tell about half of the Priests could be described as, at best, agnostic.) Anyway, they once sent me down to pick up a Donner who was bringing a 1 MILLION dollar check to the school. They were throwing a dinner party in his honor.

So off I went to pick up this guy and his MALE lover. The two of them cuddled throughout the trip. They headed off together to what ever it was that the University had planned and, late the next day, I flew them home.

So I guess being gay is okay with god so long as you have a million dollars to give away.

That being said, I'm delighted to see the US rocketing along towards the idea that you can't legislate differently for different groups. We did it nationally here just last summer.

I has been 100% legal here since December, 2012. So far, the foundations of society appear secure.

Honestly, the apparent difference is about zero- except to those who were formerly denied their rights.
