How about we strip religion from the power of marriage because in reality its governmental thing and a census thing the church doesn't need power over marriage.
Because lets get with it if two consenting same sex adults marry its on them let them be happy. Because you know equality and religion is not for equality over anything.

The point still stands, if you require different, more stringent circumstances for one over the other based on nothing more than homogeneity of gender, then it is still discrimination.
In the state in question, making a common law marriage recognized requires an inquiry presided by a judge. Meaning this bill would still give the judge the authority to deny even common law marriage based on the fact that a couple is same-sex.
"There remain four irreducible objections to religious faith: that it wholly misrepresents the origins of man and the cosmos, that because of this original error it manages to combine the maximum servility with the maximum of solipsism, that it is both the result and the cause of dangerous sexual repression, and that it is ultimately grounded on wish-thinking." ~Christopher Hitchens, god is not Great

I don't think you people understand. If *gay* people, those Devils, are allowed to get married, everyone will have to start being gay marriaged. Even little children, because gays are all pedophiles. Then God will rain hell-fire down upon us, and it shall be Armagaydon *

You forgot the part where people are allowed to marry animals. Ah, those damned dirty dirty Welsh.
"Every luxury has a deep price. Every indulgence, a cosmic cost. Each fiber of pleasure you experience causes equivalent pain somewhere else. This is the first law of emodynamics [sic]. Joy can be neither created nor destroyed. The balance of happiness is constant.
Fact: Every time you eat a bite of cake, someone gets horsewhipped.
Facter: Every time two people kiss, an orphanage collapses.
Factest: Every time a baby is born, an innocent animal is severely mocked for its physical appearance. Don't be a pleasure hog. Your every smile is a dagger. Happiness is murder.
Vote "yes" on Proposition 1321. Think of some kids. Some kids."

Religious people seem to mistake same sex marriage being allowed for it being compulsory.
The "arguments" I hear against it are bad even by religion's standards. Why they are so obsessed with what other people are doing with their lives is what worries me the most. Mind your own fucking business! We don't have to live our lives according to your fairy tale bullshit.

Hot tip: that can't end well.

Marriage has always been a private contract between families. Not until the middle ages did the government start to regulate marriage (e.g. seeking permission to marry from your liege lord). Marriage licenses as a requirement was instituted in America to prevent miscegenation (interracial marriages), the whole concept of the marriage license is based on discrimination.
So what? This is neither a defense of discriminatory practices, nor of this specific proposal. At best, it's an argument from tradition, which is obviously fallacious. What's your actual point, here?

And this is sufficient reason to block off certain segments of the population from an avenue, needlessly, in order to dodge the law?
