Wait, I thought New York didn't even have the death penalty, given that the statute for New York was declared unconstitutional in 2004, and they haven't even executed anyone since the year after my late mother was born.

Pence was on Face The Nation defending the president's tweets about Jeff Sessions moving to prosecute two Republican candidates for office. He claimed that there are DOJ guidelines against unduly influencing elections, unfortunately for him, there are two problems with this. First, those guidelines, following upon the Hatch Act, are intended to prevent people from using their power within the DOJ to participate substantially in the political process, something that Sessions was not doing. Second, the standard has been that one should be careful during the last 60 days prior to an election not to unduly influence the outcome of an election. Since both cases were initiated prior to 60 days before the election, it doesn't seem that those guidelines would even apply.

And looking at the list of people executed at the federal level, it’s only slightly more likely that they’ll actually carry through with the death penalty, since it’s only been carried out three times since 1963 and the last one was in 2003 and the other two were in June 2001.
