Okay, so perhaps it wasn't the most functional of designs but what I get from this is this "unplanned" raid on the capital included people who just happened to have the things necessary to build a gallows.  

It was obviously a symbol of intent if nothing else.
Given that he’s arguing that building a gallows on the site of a protest where people are demanding the hanging of the Vice-President (who is in a building right next to where the protest is) doesn’t really count, and the fact that he’s devoted threads to arguing that someone placing pipe bombs at the RNC and DNC headquarters isn’t so bad if the designs were rudimentary enough to be disabled, as well as arguing that the fact a man has repeatedly expressed a desire to assassinate Joe Biden and has the armory to do so shouldn’t be held against him in a court of law (to be fair, he does condemn the fact that the man had CP in his possession), I think it’s safe to assume that in Biker’s world, intent is not something worth taking into account when it comes to crime.

It’s strange that he sees the same thing that everyone did, and instead of thinking there’s some degree of complicity within the Capitol police, like most of the people who saw it, decided it’s a sign that the insurrection wasn’t so bad after all.

President Trump cannot be charged with insurrection - unless you are charging that he conspired to have himself overthrown - AS HE WAS THE HEAD OF THE.GOVERNMENT AT THAT TIME.

Did he incite a riot? Arguably so. Is he a monumental asshat? Again - that' s an easy arguement to make. Did he attempt to nullify a legal election? Sure looks like it.

But - you are an idiot trying to redefine crimes by saying it was insurrection..

The government is more than the Administration in the Whitehouse. They literally tried to override the results of an election and tried to stop branches of the government from carrying out one of their functions. Therefore the definition applies.

Trying to kill the VP and trying to stop the government from carrying out the peaceful transition of power qualifies as insurrection. An Insurrection doesn't have to be carried out against the president any of the branches of government would still qualify. Hell even flaunting the authority the government has over the peaceful transition of power would qualify.
