Under the same argument, I would say that thirty year olds do not have the mental capacity to really understand the consequences of sex and sexual activities and are therefore unable to give informed consent.
Hence divorce, adultery, and other fun stuff, like pineapple!
I was actually taking about where 12 year-olds are in terms of brain development.
