Yep. Although, since the federal government has still had a history of fighting pot legalization every step of the way, I can easily see this going before the supreme court. This is one of those progressive stances that I've wondered about Obama: why is he fighting against marijuana legalization? Isn't he supposed to be progressive?

A blood test can go back way further than one day. In fact, I think it goes back further than a hair follicle test.

That's my point. How are they going to tell (during a field sobriety blood test) if you've been smoking today or if you smoked last week but not today?

He might be more willing to allow it now that he isn't concerned about re-election.

I guess they're going to have to come up with something new. I wonder if a cheek swab would be able to tell if the person has been recently smoking.

Better yet, will it really matter as much whether or not someone was smoking weed? I mean, sure, if they are currently under the influence of marijuana I don't want them driving or opperating heavy machinery or watching my kids and I can fully understand employers not wanting them to work while high, but if you smoked a few joints over the weekend, will people care as much? As of now, employers don't like a positive drug screening, partially because marijuana is illegal; what will they say about it if marijuana is legal?

Define recently.

(some interesting stuff regarding testing procedures and their ability to "look into the past" as it were - far less than law enforcement or some stoners would have you believe.)

Specifically with regards to a swab test, it might tell you that someone has smoked within the last 72 hours...but whether or not they are currently intoxicated...well....how precisely would that be determined by such a test? The best they can do is determine a level after which they will declare you intoxicated. Wouldn't bode well for habitual users (since the tests will return higher levels regardless of their current situation). I'd expect draconian statutes and enforcement to trail the heels of widespread legalization btw. Not because I'm a pessimist, but because draconian statutes and enforcement are a huge improvement over prohibition, but not a complete reversal of the current - current.....Smile

There'd probably do a street sobriety test or something. And shine a flashlight in your eyes.

LOL, I get pretty belligerent when people shine a flashlight in my eyes regardless of what I've been smoking or drinking that day.

This laws are eaven more liberal than the dutch ones, where it`s still illegal but tolerated by state authorities.

Washington will see an increase in tourism income and state revenue within the next years which will ease the process of decriminalisation.
