In American jurisprudence, the faith requirement would only be legal if the job itself directly involves the expression of faith. If the duties of the job itself don't require faith for their performance, the requirement is illegal even if the organization is religious. Example: A Baptist church can require their couples counselor to be a Baptist, because their counseling would be through the lens of their Biblical understanding. That same church cannot legally require their groundskeeper to be a believer. I'm not a lawyer, but this is my understanding of the law. |
