I think Ashley Madison is an unsavoury business, to say the least,
but I wonder about the legal implications.
Let's say a man cheats on his wife, without the aid of Ashley Madison.
If his wife finds out about it, she can divorce him for infidelity,
and he will probably have to pay alimony and split his estate with her,
since he was the one who breached their marriage contract.
Now let's say that the husband has a buddy who facilitates his affair.
I think it is an interesting legal question if such a person can be held culpable for facilitation of breach of contract;
much like an accomplice to a murder.
But when that buddy (Ashley Madison) PROFITS by offering said facilitation services,
the legal implications may deepen;
and when you stop and consider that Ashley Madison is not only PROFITING by FACILITATING affairs,
but is in fact ADVERTISING that they have a database of potential mistresses
whom the husband has not even met, as yet,
(as opposed to a man who wasn't even considering an affair,
but unintentionally ended up falling for his secretary, let's say)
...and not only did Ashley Madison advertise that they are in possession of such a database,
but they actively ENCOURAGE people to consider breach of contract with their slogan:
" Life is Short. Have an Affair. "
The legal implications deepen even further;
and finally, when you consider that the database itself is comprised of not only potential mistresses,
but mistresses WHO ARE, THEMSELVES, MARRIED
(as opposed to having a database of single people who don't care if their hookup is married or not,
and treat Ashley Madison like any other dating or hookup site)
...then they DOUBLE their iniquity twofold, every time.
So,
For every divorce wherein Ashley Madison is implicated,
I would like to see them held legally responsible for charges along the lines of:
- facilitation of breach of contract,
- advertising a database for the purposes of facilitation of breach of contract,
- inciting breach of contract with their slogan.
As I say, if it was murder we were talking about,
anyone who even TURNS A BLIND EYE could be taken to task, legally,
nevermind facilitating or acting as accomplice,
and nevermind advertising their services as a hitman,
and nevermind ENCOURAGING people who were not already considering murder, to consider committing murder.
