As Rhythm pointed out there is no such thing as 100% when it comes to humans and justice. Hell, that's the standard we try to have right now, and that certainly hasn't stopped the innocent from being executed. As long as you have the death penalty implemented, you run the risk of killing someone who wasn't guilty.
So, which is more important? Getting revenge on a killer or just letting them rot in prison to ensure that no innocent person is executed?
