Those licensing agreements for the Trump name have unusual characteristics.
No matter how big a disaster a given development project might turn into, Trump makes money. In regards to litigation if a project goes south, Trump is off the hook. If the project is a success he can trot it out as a good example, if it fails he can ignore it with impunity and/or cite real or imagined enemies of the project (or himself) as the cause of failure, and make hay from that.
Apparently his legal staff is on retainer, so even the cost of litigation for a bad project is something he has already budgeted for and he essentially doesn't and can't lose money defending 'inevitable' lawsuits, he accepts them as the cost of doing business and already factors the (risk of the) expense in to the licensing fee.
