Yep, the legal system is flawed. Would you rather be judged by pigeons? At present, we're the only thing going capable of engaging in such an activity. That being said, we've been steadily getting better at it.
A perfect lawgiver would what? This is the all-knowing lawgiver right? He already knows what they're going to do. If he has to wait to see what they would do he isn't exactly all knowing is he.
I don't know much about rehabilitation of criminals. There's data on it, I'd defer to that. Not really my area you know.
