President Trump cannot be charged with insurrection - unless you are charging that he conspired to have himself overthrown - AS HE WAS THE HEAD OF THE.GOVERNMENT AT THAT TIME.

Trying to kill the VP and trying to stop the government from carrying out the peaceful transition of power qualifies as insurrection. An Insurrection doesn't have to be carried out against the president any of the branches of government would still qualify. Hell even flaunting the authority the government has over the peaceful transition of power would qualify.

Did he incite a riot? Arguably so. Is he a monumental asshat? Again - that' s an easy arguement to make. Did he attempt to nullify a legal election? Sure looks like it.

He clearly incited an insurrection to prevent branches of the government from carrying out the peaceful transition of power and the insurrection he clearly incited attempted to kill a member of the current administration.
