If you need to pass a federal background check when you buy a gun on the black market (notably, these are usually unlicensed (or stolen) goods): you probably aren't buying a gun from the black market, and should walk away. Why would you imagine that people would license a gun they got illegally?
There will always be asshole clients, but with the legal recognition of prostitution: many offenses committed are become chargeable without also implicating the man or woman involved for having perpetrating the 'crime' of whoredom.
Not that hookers often get (particularly/directly) punished by legal authorities for their job, but the absence of legal recognition means also a lack of legal support. The job is built inordinately upon trust, and that always has a good chance at stabbing someone in the left shoelace.
