Fortunately, there are a few states where tipped workers must be paid at least the Federal minimum wage before tips. Interestingly, all of them are in the west: Oregon, Washington, California, Nevada, and Alaska. Montana as well, provided your employer has gross sales of more than $110K.
I'm happy to live in a state where tipped workers must be paid almost $2 over the Federal minimum wage before tips ($9.19, same as non-tipped employees). No, I won't be using that as an excuse to not tip.
