Let me help you think this through, inside your little Dick-Cheney-of-a-brain. The question was asked if Obama should be prosecuted for war crimes.
1. Not prosecuting torture, which is a war crime, is illegal under US law and signed treaties.
2. Obama said waterboarding was torture.
3. Obama said he would not prosecute because it would effect CIA morale (you know, they'd have to follow the law, which according to Obama, they were not).
4. Obama violated the law.
Wait, maybe you agree with Alan Dershowitz: the U.S. should estalish "torture warrents."
