Marital rape exemptions in this country were adopted from the English common law exemption, first articulated in 1736 by English Chief Justice Matthew Hale in History of the Pleas of Crown: :"[T]he husband cannot be guilty of a rape committed by himself upon his lawful wife, for by their mutual matrimonial consent and contract the wife hath given up herself in this kind unto her husband which she cannot retract.... [I]n marriage she hath given up her body to her husband ... "
