It's not discriminatory. Well, actually I think that it is but at that point it's his right unless they entered into a contract before he found out, and tried to break the binding agreement after he found out.
He just needs to wear the shirt that says "I reserve the right to refuse service to anyone" and his bases are covered, right?

Not really. There are laws against refusing service to people based upon race, religion, or sexual orientation.
If someone comes into your business and are being a nuisance, unreasonable, or causing a scene, they can be kicked out. You know, not acting according to standard human decency.
If someone comes into your business and you don't like the color of their skin or who they might be attracted to and you kick them out, then you could be liable under discrimination laws.
