Despite our corporate owned slant on the split SCOTUS our system does work if you look at legislation history.
The "under God" Newdow case was not ruled on, it was thrown out because Newdow did not have enough custody over his kid. On top of that the district court that originally ruled in the 9th district was a republican majority.
And long ago the pledge being forced on students was deemed voluntary and not a cause brought up by atheists, but JWS.
Az at a federal level is covered by several states before it gets to the SCOTUS. And even with that you still can have republican appointed judges side with sanity.
Your job as a judge is not to take sides, your job is to be fair and impartial even if it means what you lean to does not win, the same in sports. In the west we have had hiccups and it does take a long time. But we tend to lean to protecting dissent over plutocracy or mob rule by vote.
I look at the view of Teddy Roosevelt, and Jefferson and the sad part is that neither of them could run on the republican ticket today. And especially Jefferson could not win on either ticket with how he railed against pulpit politics.
