Actual testimony includes the right of examination. Judge hasn't been examined by anybody (yet).

You are going to ignore anything against him. If this weekend didn't convince you of his lack of fitness, even beyond the assault charges, you wont understand Ford, much less us.

But we are not surprised, the bully whom nominated him joked about shooting someone on the street and getting away with it.

Yeah, NOW he is. Before, he refused to be a witness. The FYI will apply pressure so now he's more than willing to cooperate on the condition that it's all done "confidentially". Whatever the fuck that means. The results of the investigation are not going to be kept under wraps.
