And he wasn't making a dime off of copying and pasting the clip either. The point should not be to punish fans, but punish pirates who mass produce fake products.
Apparently this whole stupid process is meant to provide full-time employment for lawyers.

Fair use covers the distribution of all or part of a work for certain purposes, something Youtube is not doing. And the distribution of complete works you do not have the rights to outside of fair use is a crime, even one song. It doesn't matter whether you credit the original author or pass it off as your own work. And profit or monetary compensation isn't a requirement for a violation.
