Legal and moral are two different things.

"Fair use" is also law, but they are abusing that. It is only illegal to pass something off as your own. It isn't illegal to play short clips of anything. This is just Youtube trying to avoid lawsuits. 

It is the same stupid crap with the NFL, because they have fleets of lawyers, just know, the owners of this website are not billionaires, and if the NFL wanted to be dicks, they could order a "cease and desist" order. Thus their BS disclaimer "descriptions or accounts of the game, without express written permission is strictly prohibited"......  So every NFL fan should not be allowed to post pictures of their favorite logos or or use those team logos as their avatar? 

Minn didn't post the video because he was claiming to be a CBS exec, nor was he claiming to be a producer, he is simply a fan, like me who enjoyed the clip. And he wasn't making a dime off of copying and pasting the clip either. 

The point should not be to punish fans, but punish pirates who mass produce fake products.

Good luck with your "fair use" defense in court. Fair use covers the distribution of all or part of a work for certain purposes, something Youtube is not doing. And the distribution of complete works you do not have the rights to outside of fair use is a crime, even one song. It doesn't matter whether you credit the original author or pass it off as your own work. And profit or monetary compensation isn't a requirement for a violation.

So, no, Brian, you've simply been caught with your pants down around your ankles.
