Generally speaking, emotional feelings are what laws and sentences are based on. Granted it is inconsistent from place to place but still it's a fact.

Perhaps I have more distaste for official corruption than you do? Relatively few states even have statutes which define "home invasion," usually, it is just called "robbery." And like most other crimes the numbers have been trending downward for a long time now. The last "home invasion" ( I do not object to the characterization, btw) out here was one drug dealer being shot by 3 others. Take drugs out of the mix and that level of crime will decrease too.
Nevertheless, Blackout is correct.

Laws are written according with what's best for society, not your personal feelings. If it were, the death penalty would still be allowed because many people wish criminals to be executed.
It's a fact? Give me proof. Old conceptions of what laws should be about since Kant have argued in favour of rationality and what's best for all, what benefits society more.
Your lack of knowledge on [criminal] law doesn't add much to this cause.
To further argue my point, the penal code in my country says specifically that impartiality is a must and presumption of innocent is important, as well as that trials aren't Criminal V. Victim, but Criminal V. Society

You need to read up on the Wild West. It was no where near as wild as you seem to think.
I always found it one of the great ironies of life that the Gunfight at the OK Corral happened because the local officials were trying to enforce Tombstone's Gun Control law on a bunch of rowdy cowboys.
No. People in the "Wild West" were nowhere near as stupid as gun nuts today.

I don't consider the US a good model of how the criminal system should be ran, particularly because of the death penalty, ridiculously high sentences and sometimes too hard for crimes, criminalization of acts that shouldn't be illegal (i.e. Incest and drug consumption or possession) and the prison system -- In fact my professors frequently state that not following the American justice system is a high priority for us. By your logic a woman should be stoned to death if she is raped as long as it is the law. After all it what's best for society.

I don't think you're wrong, please don't think that. I'm just highlighting how difficult it is to make statements such as the one I quoted and remain consistent.

Yes towards the American criminal Justice system... But it goes a long way from me making a value judgement during a conversation and letting my emotions or feelings [personal] determine how I should write down a law - Not to mention laws are written down by a number [more than one] of people, so usually one's feelings don't dictate it... Everything we do is determined by our feelings, because we feel like doing it - But it doesn't mean we can't use our rationality... And feelings isn't the same as emotions - check this out to figure out why.
