Quote:Ohio Supreme Court: No, Judges May Not Refuse To Marry Same-Sex Couples
Quote:The Ohio State Supreme Court has issued an advisory opinion after a judge in Toledo asked for an accommodation to refuse to marry same-sex couples because of his sincerely-held religious beliefs. According to the opinion, judges may not opt out of performing all marriages, and they cannot refuse to marry same-sex couples.
Quote:A judge should further be mindful of the requirement under Jud. Cond. R. 2.3(A) to
perform administrative duties without bias or prejudice despite the judge’s personal,
moral, and religious beliefs.
In other words....STFU and do your fucking job.
Interesting. I would think they would let him recuse himself from performing any marriages. It is a good thing this is just an advisory opinion and not binding. I imagine it would run afoul of the first amendment and international law as established in the Nuremberg trials by which a person in service of the government may not be compelled to act in a manner they find immoral or unethical.
