The problem is that we can't guarantee that until negotiations actually start and that won't be till after Article 50 is actually triggered, which is above all a condemnation of the stupid rules imposed regarding A50. That should have been settled almost immediately after the referendum, I can see no sane reason for the fate of EU and UK expats to have been dragged out like this.
