The problem is that the future is unknown. So really, we're considering not a balance of guaranteed outcomes, but of chances.
If I knew, for example, that New York would be bombed by muslim terrorists (i.e. I had a time machine), then I might consider torturing or killing many thousands of innocents to get at the actual perpetrators.
But since that kind of information is impossible to have, I couldn't justify just randomly torturing or killing people because they might know a guy who knows a guy who talks big about what he wants to do to the US.
