Our coupster courts are going to turn a blind eye to this as long as they feel they are in power...and come down hard against it as soon as they think it might help "the other guy". Settled law is whatever helps me today, while major issues are whatever may arise to hurt me tomorrow.
My point is that while candidates can campaign trotting out "terrorists", people will fall for that story-line.
