Sure, individual atheists believe in the death penalty. And individual atheists don't believe in the death penalty. It's not really how you determine if someone is an atheist or not.
Now, if you're asking about atheists as a group, the only thing we believe collectively is that there is no god (and even that's up for discussion).
As for me, I'm kinda torn on it. I see how corrupt the state and our justice system is and I know perfectly well that racial minorities and generally poor people are more likely to be imprisoned; I'd be more than willing to be they're more likely to be executed, too, even when wealthy people commit worse crimes. On the other hand, there are people out there who are so horrible that they will never ever be constructive to society and that we would be better off without (Charles Manson comes immediately to mind).
