Courts and ACLU are all over their ass for prison problems. Also, they've had a riot with IIRC a couple fatalities. Dire personnel issues too, required overtime isn't standing up in court, and prison system just can't attract sufficient employees to work there.
Nebraska either figures out a solution, or the courst are going to be running their prison system for them, and the courts aren't going to care about blowing the state finances to smithereens to do it.
Comes down to $$$. If fixing problem themselves is realized to be cheapest answer, Nebraska unicameral will be all over it like pale green on baby puke.
The granting of a pardon is an imputation of guilt, and the acceptance a confession of it.

I wasn't aware that Nebraska, after being on-board for inflated incarceration costs in the first place, would suddenly become so fiscally responsible. Are you sure they wouldn't rather cut programs for useless takers and keep those people in for profit prisons?

It's becoming a black hole for state money.
Nebraska is courting more pricey lawsuits over death penalty cases too. More prison budget money going to lawyers and not towards a minimum number of guards to maintain safety and order in the facilities.
Overcrowding in cells is garnering court attention too. I wonder if Nebraska ACLU isn't also funding limited too, surprised they are not filing more suits more often. There's no shortage of scary shit in the newspapers they could be filing on.

A cursory google search shows me that, in Nebraska, state run prisons are also profiteering on the backs of prisoners.
I share your hopefulness, but not your confidence. That we've sequestered a percentage of our population in prisons in the face of that immense economic loss leads me to believe that no price will be too great in the pursuit of all of the myriad goals serviced by our prisons (private and public).
It's difficult to imagine nebraska vacating them. They'll probably have to be drug kicking and screaming into it, by lawsuits...and empty pockets - as you've been alluding to.
