I'm on your side, remember?

Like hell you are. Nothing like a lying man to give me that warm, stabby feeling inside.

That will never hold up in court...

One man's loophole is anothers incentive - in other words, many of the "loopholes" that reduce corporate tax burden are intentionally codified as incentives, or are incentives that are used in unintended ways. The point is - every new incentive is an invitation to game the tax system. In addition - as long as there is economic incentive to reduce labor costs by using foreign labor, there will be those that do so. That being said, I too would like to see this practice disappear, I'm just not convinced it can be done.

I don't see a way it can be done that doesn't also reduce 'insourcing'. Thousands of foriegn companies set up shop in the USA and employ millions of Americans. Refusing to allow American companies to do the same would not sit well with the global community. It isn't so much something to be eliminated, more like something to make sure we're not unduly incentivizing.

Thanks for bringing this factor up - it had not occurred to me at the time I wrote my TL;DR post.

I don't think outsourcing labor to foreign countries can be eliminated, but certainly keeping a balance between outsourced and insourced labor is desirable.
