What sort of BAC should be present before someone is considered too drunk to fuck? Would it generally be assumed to be .08 like the driving limit?

Before anyone asks, This is not in any way meant to be a rhetorical question. I honestly think that with a rule like that, guidelines for what counts as "too intoxicated to consent" need to be made if there's supposed to be any sort of meaningful standard. I mean, I can see where the standard is coming from, and if it's clear that the intoxicated person is passed out or is so far out of it they can't tell what's even happening, then they can't really consent to sex. Beyond that, I'm not sure how meaningful such a statement can even be. That could just be the ASD talking, but it looks like between "first drink" and "too wasted to know what's going on" there exists a big grey area where consent may or may not be possible and I'd like to know where the limits really are.

If we go by this definition (which may or may not be true ) then yes if you don't like that conclusion then it's not my problem . And what your experience is counter other experiences so it's just subjective opinion .

There's almost always some legalese about substantial intoxication or substantial impairment.

(and, no, it's generally not the same as the limit to drive, mostly, because a person can safely operate their genitals at a point far beyond what we might trust them behind the wheel of a truck at - though I can see a great sketch there.. sobbing "omg occifer, I just didn't see him there, I had a few to many to drink and I looked away for one second and then next thing you know, bam, I ran him over with my giant vag! Well, at least we know it's higher than the driving limit, but the question remains: how substantial is substantial intoxication?

And are we sure that the woman in the song has even had enough to reach that point?

And generally the cops tell you not to drink and drive period

And let me repeat this again this can happen to women or men

Not to mention the case were a women in Halifax who was rendered unconscious and was assaulted . Judge still called it consent .

Tiz, you seem to be using a bit of theist binary thinking on this subject. There is such a thing as nuance, you know. If I tell my husband, “hey, I’m feeling frisky. Pick up a bottle of wine on the way home. I want to get pleasantly drunk and have sex with you,” and then I do exactly that...that is not rape. If I come to AF the next morning and say, “dude, Chris and I had the BEST, hottest drunken sex last night,” you don’t get to tell me that that is rape, no matter what I say or feel. That’s absurd. That is absolutely robbing a woman of her autonomy. You’re basically saying, “your thoughts and feelings about what you did with your body are irrelevant.”
