But the photo the sister took is irrelevant in the sense that it would do nothing to prove or disprove the crime of murder. We know that Mr. Arbery is dead as a result of gunshot wounds inflicted by Mr. McMichael - these facts are not in dispute, and the photo does nothing to alter that. If she had provided video of the shooting from a different vantage, things might be different.

Muder is simply killing someone intentionally, the perpertrators had no legal grounds to apprehend the victim which is a fact.

It shows her mentality.  It says nothing about the motive of her father and brother (means and opportunity are not in dispute). The only purpose of such a photo as evidence would be to play on the emotions of the jury, and that's not how trials are meant to work.

I have no doubt she took the photo as a souvenir, which strikes me as pretty fucking sick.  But it still shouldn't be admitted as evidence, because it adds nothing factual to the case.

And just to be clear, I DO think this was a murder, and I would like to see the two men sent to prison for the rest of their lives.
